Scandal-plagued engineering firm and other Canadian companies make up a fifth of the list

Canada leads the world in companies and individuals that have been banned by the World Bank from contributing to international aid and infrastructure projects.
Of the 608 companies and individuals listed on the World Bank’s just-released blacklist for fraudulent or corrupt conduct, 119 are Canadian companies. But engineering firm SNC-Lavalin and its subsidiaries, many of which are registered outside Canada, comprise 16 per cent of the total.
The World Bank bans companies from participating in aid and development contracts if they “have been sanctioned under the Bank’s fraud and corruption policy.”
The number of companies included on that list soared in 2013, rising from only 65 banned entities on last year’s list, according to the South China Morning Post. The World Bank says about $40 billion of the roughly $200 billion it has given out since 2008 has been stolen.
Companies with head offices listed in Canada, which does not include overseas subsidiaries, comprise 119 names on the World Bank list, the most of any country. The U.S. is second with 44 debarred firms, Indonesia third with 43 and Britain close behind with 40.
The grounds for getting blacklisted vary, but usually include some manner of bribery, fraud, collusion, coercion or obstruction either in bidding for contracts or in carrying them out.
The RCMP raided the Montreal headquarters of the engineering and construction giant in April as part of an investigation into $56 million in mysterious payments. One multimillion-dollar payment allegedly went to the family of former Tunisian dictator Zine el Abidine Ben Ali to win construction contracts in the North African country. The company also had ties to Libya’s former dictator Moammar Gadhafi.
The former CEO of SNC-Lavalin, Pierre Duhaime, was charged with fraud in late 2011 in connection with the Quebec anti-corruption commission, which has been probing corruption in the province’s construction sector.

SNC-Lavalin engineer turns Crown witness in Bangladesh bribery case

Former SNC-Lavalin executives accused of bribery in Bangladesh are facing two pieces of potential bad news: one from the Supreme Court of Canada and the other from an engineer who is prepared to testify against his former bosses.
The Supreme Court ruled Friday that the World Bank's anti-corruption staff have immunity and don't have to appear in court in Toronto to provide information about the whistleblowers who first sounded an alarm about the engineering giant's efforts to secure a supervision and advisory contract for the $3-billion Padma Bridge project in Bangladesh.
Lawyers for former senior vice-president Kevin Wallace had argued the defence should be able to examine bank records and challenge the World Bank investigators because they initially tipped off the RCMP, who then set up wiretaps to investigate the SNC-Lavalin employees.

Montreal-based engineering firm SNC-Lavalin Inc. has settled a complaint from the World Bank that will see the company forbidden from bidding on any projects funded by the international monetary body for at least 10 years.
While the specific terms of the settlement are confidential, SNC-Lavalin said in a release Wednesday it has agreed to be suspended from bidding on any construction projects that are backed by the World Bank for the next decade.
The ban applies specifically to SNC-Lavalin Inc., a subsidiary of SNC-Lavalin Group, and any "controlled affiliates."
The World Bank has not commented on the reason for the complaint or the settlement.
Payments scandal

SNC-Lavalin is embroiled in an ongoing scandal surrounding improper payments the company may have made to secure construction contracts in North African nations including Libya under Moammar Gadhafi.
Last fall the company's former CEO, Pierre Duhaime, was arrested and charged with fraud in connection with the contract to build the McGill University superhospital in Montreal.
And just last month, a top executive with the company admitted to dubious political donations while testifying at the Charbonneau commission, which is looking into corruption in Quebec's construction industry.
"The company's decision to settle signals our determination as we go forward to set standards for ethics in business conduct and for good governance that are beyond reproach," SNC-Lavalin CEO Robert G. Card said. "The company has already taken, and will continue to take, measures to ensure rigorous compliance and control procedures are in place."
In the release, SNC-Lavalin noted that World Bank-funded projects currently make up less than one per cent of its revenues.

World's Biggest Sovereign Wealth Fund to Decide on Dumping Oil

Norway will announce on Friday whether its sovereign wealth fund, which is the world's biggest and has been fuelled by petrodollars, will divest its oil and gas holdings in a decision keenly awaited by climate activists.
While the decision is said to be based solely on financial considerations and not on the environment or climate change, a divestment by an investor worth more than $1 trillion would be a major blow to polluting fossil fuels.
Finance Minister Siv Jensen is expected to present the government's position at a press conference at 12:15 pm (1115 GMT).
Norway's central bank, tasked with managing the mammoth fund -- commonly referred to as the "oil fund" but formally known as the Government Pension Fund -- made headlines in November 2017 when it called for the divestment of oil stocks in order to reduce the Norwegian state's exposure to the volatile oil sector.
"This advice is based exclusively on financial arguments and analyses of the government's total oil and gas exposure," the bank's deputy governor Egil Matsen said at the time.
It "does not reflect any particular view of future movements in oil and gas prices or the profitability or sustainability of the oil and gas sector," he added.
In Norway, the biggest hydrocarbon producer in western Europe, oil and gas represent almost half of exports and 20 percent of the state's revenues.
All revenue from the state-owned oil and gas companies are placed in the sovereign wealth fund, which Oslo then taps to balance its budget.
In order to limit the state's exposure in the event of a steep drop in oil prices -- as was the case in 2014 -- the idea would be to no longer allow the fund to invest in oil stocks and sell its existing holdings.
At the end of 2018, the fund had holdings worth around $37 billion in the oil sector, with significant stakes in Shell, BP, Total and ExxonMobil among others.

After hours of debate on wording, the US House of Representatives on Thursday passed an anti-hate resolution condemning anti-Semitism, discrimination against Muslims, and other forms of bigotry against minorities. The resolution passed with a vote of 407 to 23.

The four-part documentary, titled The Lobby — USA, was filmed by an Al Jazeera undercover journalist, called "Tony", who infiltrated the Israeli lobby during a five-month operation and earned the trust of its leaders.

Every week or so an invitation, announcement or appeal arrives in my inbox heralding the work of the Centre for Israel and Jewish Affairs (CIJA), Canada’s leading Jewish lobby.
The message is often under the name of Martin Sampson, its director of communication and marketing. But it might also come from one of the self-described legion of “analysts, public affairs specialists, web and social-media practitioners, relationship-builders and media-relations experts” in CIJA’s offices in Montreal, Ottawa, Toronto, Vancouver and Israel.
CIJA is a public relations machine. Then again, when you are the country’s most significant registered Jewish advocate, there is much to do – and, apparently, little you do not do.
Consider its list of priorities. To “advance” a constructive Middle East policy, “increase” trade between Canada and Israel, and “secure” restitution for Holocaust survivors. To “protect” Canadians from hate speech and minorities from discrimination in the Middle East. To “ensure” access to affordable housing, equality in society, and a fair refugee system. To “prevent” terrorism and genetic discrimination.
There are some 18 priorities, which suggests doing everything but baking challah for Shabbos. Perhaps it’s symbolic; the number 18 represents Chai, or life, in Hebrew.
Much of CIJA’s work is commendable, even indispensable. Indeed, some of its mission is motherhood: protecting schools, promoting kosher food, improving palliative care and fighting anti-Semitism.
Since it absorbed the venerable Canadian Jewish Congress in 2011 – a mysterious, hostile takeover cheered by some conservative Jewish donors – CIJA has become “the exclusive agent of the Canadian Jewish Community.” But as Bernie Farber, the esteemed human rights activist and former head of the Congress has argued, CIJA is nowhere as vigorous on social justice and real inter-faith dialogue at home. Curiously, “Canada” is not even in its name.
The trouble with CIJA is not only that it has too many causes. The problem is its advocacy, which largely means pushing the government of Canada to embrace positions on Israel that run counter to the views of many in our community. The problem is its money and its accountability.
Here CIJA is evasive, refusing to disclose its budget; in its messaging, it is inept and amateurish. When I asked basic questions, the perfervid Martin Sampson insisted repeatedly we meet. When I declined, preferring written exchanges, he went silent.
CIJA refuses to discuss its annual budget, which comes almost entirely from Jewish Federations of Canada, an umbrella organization of Jewish charities. CIJA itself spends an estimated $8 to $11 million, 40 per cent on advocacy on Israel alone.
How it advocates came home to me in December, when I listened to three experts on a conference call convened by CIJA. The subject was the decision of the United States to move its embassy from Tel Aviv to Jerusalem, formally recognizing it as Israel’s capital.
Naïvely, I expected a range of opinion. But each speaker applauded the move. Not a dissenting voice among them.
Of course, this is what CIJA does: it takes positions on Israel, often echoing those of the Benjamin Netanyahu government, and implies they are shared broadly by Canadian Jewry.
When Canada abstained in the subsequent vote by the UN General Assembly condemning the decision, CIJA expressed disappointment. (Only nine nations supported the U.S., but CIJA lamented that Canada wasn’t among them). It didn’t matter that formally recognizing Jerusalem is opposed by many, possibly most, Canadian Jews.
So, what to do if you question CIJA’s lobbying but support its work through your annual contribution to the United Jewish Appeal?
First, demand that CIJA reflect a more progressive view on Israel, one that mirrors Canadian Jewry. Moderate Jews align with the Liberals on Israel. It is CIJA, and its conservative acolytes, who think otherwise, which made it a shill for Stephen Harper’s government.
Second, demand a change of leadership. Shimon Fogel, its founding CEO, was close to the Conservatives. Like them, he opposed the anti-nuclear deal with Iran in 2015, which is working. He should go.
Third, if CIJA’s hardline stance on Israel remains, urge the federation to allow its donors to opt out of funding CIJA. Let them designate funds to other charities. If CIJA wants to advocate for Netanyahu, let it do so as an independent agency, with its own resources.
If there is no change in CIJA, and no new means of designation, donors can withdraw support from CIJA, as I will. Instead, we can support many fine individual charities, such as Tamir, Hillel Lodge, Birthright Israel Foundation of Canada, JSpaceCanada and the New Israel Fund of Canada.
Federation supporters should know that their money finances an agency that speaks in their name and adopts positions on Israel that many Canadians oppose.

This is not about Jews. It is not about race, ethnicity or religion. It is about power. The new Israel lobby in Canada – the Canadian Council for Israel and Jewish Advocacy (CIJA) – has enormous power, derived from abundant resources, corporate connections, political associations, elaborate and able organization and a cadre of dedicated activists. Since its inception several years ago, this hard-line lobby has used its power, first, to gain political hegemony and impose ideological conformity on the matter of Israel within a heretofore diverse Jewish community, and second, to influence government decisions and shape public opinion regarding Israel – ostensibly in the name of all Canadian Jewry. From the outset, a primary focus of this lobby’s attentions has been the university campus, alleged centre of anti-Israel sentiment, conveniently construed as anti-semitism. Over the last two years, the lobby has by various means attempted to pacify these campuses and bring them into line, particularly Concordia and York. While the lobby has made some significant gains, at York their effort has been stalled.
A Hostile Takeover

Not everyone was happy with the new extremist conglomerate. “What we are talking about here,” one official told Toronto Life, “is essentially a takeover of the country’s Jewish institutions.” Frank Dimant, executive vice president of B’nai Brith Canada, which belatedly – and grudgingly – entered into an agreement with CIJA, pointed out that “the group known as the Canadian Council for Israel and Jewish Advocacy had on its inaugural steering committee some of the most powerful men and women in this country.” CIJA co-chair Brent Belzberg himself acknowledged that “this is being seen as a bunch of rich guys telling the others what to do.”
According to the Forward, one observer described the CIJA’s incorporation of the CJC and the CIC as a “hostile takeover,” while another told the Toronto Star that it amounted to a “coup d’état by powerful financial interests bent on cementing their control over Jewish advocacy activities in the country,” adding that “these guys are used to getting their way.” “This is a group of self-appointed people who have very little linkage with the Jewish [masses] and they have private agendas of their own,” Thomas Hecht, former Quebec chair of the CIC, pointed out.
According to the Toronto Star, some members of the community believed that the CIJA “will put control of Jewish lobbying efforts in Canada into the hands of a few wealthy and powerful individuals.” “It’s the funders who will determine the policy,” B’nai Brith’s Dimant insisted; “they will be deciding policy for all those entities.” “I think it’s a process cloaked in secrecy right now,” he added, cautioning that, “It’s a dangerous move.” “The underlying theme is a total centralization of Jewish thought, opinion, and messaging. It’s an attempt to silence the activists in our community.” In the eyes of some Jews, then, the formation and agenda of the CIJA, which even in its name conflated the term Jewish with Israel, constituted a threat not only to Jewish critics of Israel, but also to Jewish moderates, a hijacking of Jewish identity in Canada by a well heeled and politically well connected cabal of zealots.

Online history video on the battle of Spion Kop, the bloodiest battle of the Anglo Boer War in South Africa 1899 - 1902, where Winston Churchill reported that up to seven bombs per minute were landing on top of the Spion Kop mountain with massive clouds of orange lydite and that the British soldiers in the trenches were being blown to atoms. Known as the 'Acre of Massacre', it remains the smallest piece of ground on which more men lost their lives in a single battle than any battle fought anywhere in the world… and it is here, witnessing what the human race was capable of, that the seeds of Mahatma Gandhi’s passive resistance took root.
